These Terms & Conditions govern all bookings made with Aurient Travel Pty Ltd (“Aurient Travel”, “we”, “our”, “us”) for travel services operated by the Tour Operator in China. By booking with us, you (“the Customer”, “you”, “your”) agree to these Terms & Conditions.
1. Booking & Confirmation
1.1 Your booking is confirmed once we have received your full payment and issued a written confirmation.
1.2 All arrangements are subject to availability at the time of booking.
1.3 Bookings are accepted on the understanding that you have read, understood, and agreed to these Terms & Conditions.
1.4 No reservation is confirmed until full payment is received.
2. Payment Terms
2.1 A full amount payment (amount stated in your booking confirmation) is required at the time of booking.
2.2 All prices are quoted in Australian Dollars (AUD) unless otherwise stated and are based on the exchange rate and costs in effect at the time of quotation.
2.3 Payments may be made by bank transfer or other approved methods; transaction fees may apply.
3. Pricing & Itinerary Changes
3.1 Prices include only those services specifically stated in your itinerary or invoice.
3.2 Prices do not include airfares (unless specified), visa fees, travel insurance, personal expenses, meals not specified, tips, or optional activities.
3.3 We reserve the right to adjust prices in the event of significant currency fluctuations, changes in government taxes, or other cost increases beyond our control.
3.4 The Tour Operator may propose changes to the services (subject to availability and acceptance by both parties), including pricing and itineraries, provided that reasonable notice of no less than 14 days is given to the customer prior to the scheduled departure date.
3.5 Any such adjustments will be communicated to you prior to final payment.
4. Changes & Amendments by You
4.1 If you wish to make changes to your booking, requests must be made in writing and are subject to availability.
4.2 Alteration of Travel Date:
- 60 days or more prior to the scheduled departure date – alterations (including change of travel date or destination) can be made without any alteration fees, subject to availability.
- Less than 60 days prior to the scheduled departure date – alterations such as changes to departure date or destination may incur cancellation fees as outlined in Clause 5.
4.3 All changes are subject to availability and cannot be guaranteed.
4.4 Traveller substitutions are considered reservation cancellations and are subject to the cancellation fees outlined in Clause 5.
5. Cancellation & Refund Policy
5.1 All cancellations must be made in writing.
5.2 The following cancellation fees apply:
- 60 days or more prior to the scheduled departure date – fully refundable (note: card payment surcharges are not refundable).
- 45–59 days prior to the scheduled departure date – 15% of the full payment per person.
- 15–44 days prior to the scheduled departure date – 30% of the full payment per person.
- 7–14 days prior to the scheduled departure date – 75% of the full payment per person.
- 0–6 days prior to the scheduled departure date – 100% of the full payment per person.
5.3 Additional cancellation fees, if applicable, imposed by service providers other than the Tour Operator (which may include but not be limited to banks or other payment platforms, airlines, cruises, hotels, railway companies, etc.) will be deducted from the money to be refunded.
5.4 After the trip commences, we are unable to refund any amount for unused services due to your early departure, late arrival, or missed days on tours. The unused services include but are not limited to hotels, air or train tickets, meals, and admission fees.
5.5 Refunds will be processed back to the original form of payment within a reasonable time frame, less any applicable fees.
6. Cancellation or Changes by Us
6.1 We may cancel a booking due to force majeure (events beyond our control, such as natural disasters, pandemics, government restrictions, political unrest, or severe weather). In such cases, we will offer a credit or refund where possible, less any unrecoverable costs.
6.2 We reserve the right to cancel any trip for operational reasons or insufficient bookings; full refunds will be provided in such cases.
7. Force Majeure
7.1 Neither Aurient Travel nor the Tour Operator shall be liable for failure to perform obligations due to events beyond their reasonable control, including but not limited to natural disasters, pandemics, government restrictions, strikes, civil unrest, or war.
7.2 The affected party must notify the other as soon as possible and make all reasonable efforts to resume performance.
8. Travel Insurance
8.1 Comprehensive travel insurance is strongly recommended for all customers and may be mandatory for certain itineraries.
8.2 It is your responsibility to ensure that your insurance covers medical expenses, trip cancellations, loss of baggage, and other personal risks.
9. Flights & Airport Transfers
9.1 International flights to and from China are not included in your tour package and are the sole responsibility of the traveller to book and pay for.
9.2 You must arrive at the designated meet-up airport by the scheduled tour start time and depart from the tour’s final airport as per the published itinerary.
9.3 Airport transfers are provided only for the scheduled arrival and departure dates and times listed in your itinerary. Travellers arriving or departing outside these times are responsible for arranging and paying for their own transfers.
9.4 No-shows — defined as failure to arrive at the designated meeting point at the scheduled time — are not eligible for any refund, credit, or amendment, and unused services will be forfeited.
10. Passports, Visas & Health Requirements
10.1 You are responsible for ensuring that your passport is valid for at least six months beyond your intended stay and that you meet all visa and entry requirements for China.
10.2 We are not responsible for losses due to incorrect documentation or failure to obtain the required visas.
10.3 You must disclose any existing medical conditions that may affect your participation in the tour.
11. Tipping Policy
11.1 All gratuities for guides and drivers are included in the final package price and calculated on a per-person basis.
11.2 Travellers will be advised in the Pre-Departure Information Pack that tips have already been covered by the Tour Operator, and that tipping is not required nor expected during the trip.
12. Traveller Eligibility & Special Arrangements
12.1 Solo travellers are welcome — single supplement applies for a private room.
12.2 Children’s Policy:
- Children aged 11 and under receive a discounted rate when sharing a bed with a parent. If the child requires a separate bed, a single supplement will apply.
- Children aged 12 and above pay adult rates.
12.3 Customers with special needs or medical conditions should notify us prior to booking to ensure appropriate arrangements can be made (see Clause 10.3).
13. Responsibilities & Liability
13.1 Aurient Travel acts as a wholesaler and booking agent for the Tour Operator and other suppliers. We do not own or operate the services provided and are not liable for the acts or omissions of these suppliers.
13.2 To the extent permitted by law, we exclude all liability for any loss, damage, injury, delay, or expense caused by any third party, force majeure event, or circumstances beyond our control.
13.3 Nothing in these Terms & Conditions limits your rights under the Australian Consumer Law.
14. Complaints & Feedback
14.1 If you have a complaint during your trip, you must notify your local tour guide or the Tour Operator immediately so they can attempt to resolve the issue on the spot.
14.2 If the matter is not resolved, please contact us in writing within 14 days of returning home.
15. Confidentiality & Privacy
15.1 We will collect, store, and use your personal information in accordance with our Privacy Policy and applicable Australian privacy laws. Our Privacy Policy is available on our website or upon request.
15.2 Your information will be shared only with the Tour Operator and relevant suppliers for the purpose of fulfilling your booking.
16. Governing Law
16.1 These Terms & Conditions are governed by the laws of Australia, and any disputes will be subject to the jurisdiction of Australian courts.
